Terminations are one of the highest-risk moments for a business. Not because you can’t terminate, but because of how decisions are made, communicated, and documented.

Here’s a simple checklist to help you terminate with clarity, consistency, and reduced risk.

First: make sure the decision is solid

Before you schedule anything, confirm:

  • the reason is clear (performance, misconduct, role elimination, etc.)

  • you have documentation that supports it

  • you treated similar situations consistently

  • Confirm final decision-maker approval

Pay and benefits

  • PTO payout rules (based on your policy/state practice)

  • Benefits termination date and process

  • COBRA/continuation notices (as applicable)

Company property & access

  • Return equipment (laptop, badge, keys)

  • Disable access (email, systems, apps) at the right time

  • Protect sensitive data and customer information

The meeting

  • Keep it short and respectful

  • One clear message: decision + next steps

  • Don’t argue the details

  • Provide a written summary of logistics (final pay, benefits, property)

After the meeting

  • Notify internal stakeholders on a need-to-know basis

  • Document what was said and provided

  • Reinforce expectations with remaining team (without oversharing)
